bank snooping, abolishing juries, suing governments under trade treaties, the drift

A twin terrible moment for civil liberties, sending civil liberties voices' alarm setting sky high. The present move to massively reduce use of juries in Englandandwales, and now passed the present Britishwide introduction of snooping powers over welfare recipients' bank accounts. Both these at once. Both need the COURT CHANGE used by all parties resisting them.

On juries, this is both to cite the court change against the change happening, and if it still happens, to use the court change in actual cases. In Scotland, where the extent of right to juries is weaker, still 2 recent attempts to partly abolish them were successfully stopped, including by lawyers' opposition. The SNP government tried to suspend juries entirely at Covid's outset. Then straight after a jury defeated its attempt to frame Alex Salmond, it stood on a policy to abolish juries in sex cases where even the present English proposal keeps them, and where even without doing that, the Supreme Court case recently proved Scottish law to have practised unjustly in the witch-hunting of men.

So the political elite, including from the left, has been dangerously after juries for a long time already. All organisations who stand for civil liberties, who voice any resistance to this change, are evidenced only to mean what they say if they acknowledge the court change, cite it against the juryless process's demerits, and are not ignoring it. The court change is a serendipitous resource in this which they can't afford to leave aside.

The move against juries is part of shift from proper democracy to business controlled government, corporatism. A Guardian item on which by George Monbiot, Dec 1, has been welcomed by Helena Norberg-Hodge of the Local Futures mailing list. To which today she wrote in response, it -

《 details the ISDS clauses, written into free trade treaties, which give foreign corporations – and only foreign corporations – the right to sue governments, sometimes for many times their annual GDP. This is what I mean when I say, as I did in a recent video currently doing the rounds on social media, that this is a completely illegal global system.

Trade treaties have been the dark secret of the global economy for decades. Both the Left and Right have been handing over their wealth and power to global monopolies, making a complete mockery of democracy and giving rise to Corporate Rule. This lies not only behind the complete failure in the climate arena, but is also a primary reason why more and more people are forced to run faster and faster just to put food on the table and a roof over their head. As a consequence of these increasing pressures on people, we are witnessing a frightening political swing toward fascism.

And the good news is that this is not so much about "good guys" and "bad guys" as it is about blindness. It’s my experience that the majority of our political leaders have not had a clue about this, nor have most social and environmental activists at the grassroots – not even the majority of people inside these giant monopolistic corporations! 》

She asks for circulation of it - 《 That this corporate empire threatens all of us gives us reason to unite like nothing else.

But with the court change too. This campaign too will unaffordably miss a resource if it neglects the court change. George Monbiot has not exposed the court change, and nor have campaigns against corporatism for a generation already. Uniting includes automatically taking up all resources contributed by anyone. It will visibly only be meant if it acknowledges and uses the court change.

yes George, show us what the democratic means is


Because as we are now, devolved, eveyone living in Englandandwales is at liberty to escape this shocking pre-fascist virtual banning of protests and demonstrations there, by moving to Scotland. Compare that to how a Scottish state under racist "civic nationalism" would want to reject even some Scots from making that move. To make citizenship by descent tefusable is to hand over our economic emigrants' families, on a plate, to what George Monbiot has described in the Guardian.

Paragraph from a Guardian article by George Monbiot, 19 Oct 2022, on public apathy towards environmental protest:

《 Writing for the Mail on Sunday, the home secretary, Suella Braverman, claimed: “There is widespread agreement that we need to protect our environment, but democracies reach decisions in a civilised manner.” Oh yes? So what are the democratic means of contesting the government’s decision to award more than 100 new licences to drill for oil and gas in the North Sea? But George Monbiot himself ignored the court change, after he spoke at a Globalise Resistance conference in Glasgow 2001.

The court change benefits fightability of everything he urgently cares about. Since he has experienced arrest on an environmental protest, intentionally indeed, George Monbiot arrested for defying Extinction Rebellion protest ban - 2019,  he surely has every personal motive to care against the largely media-ignored violation of the human right to presumption of innocence, by the US and Canadian border systems giving innocent arrested people a worse status for entry. The court change helps fightability of that too.

So WHEN MONBIOT URGES YOU TO LISTEN, ON THE ECO EMERGENCY, MAKE IT CONDITIONAL. ONLY LISTEN ON CONDITION THAT HE EXPRESSES SOME LISTENING TO THE COURT CHANGE.

guilt by quack theory

SOMEONE POSTING ON THE STURGEON/SALMOND SCANDAL HEARINGS - I have a background in understanding and teaching non-verbal communication having studied it at length, and delivered workshops and training to a multitude of groups including trainee psychiatrists, psychiatric nurses, police officers and social workers.

ME - As a civil liberty concern towards this idea of "teaching non-verbal communication" from involuntary mannerisms not intended to be communication at all. - Post-traumatic stress and autism are both things that can make innocent folks show the same nerves or blanked emotion, as hasty or high-handed police/psychiatrists/teachers like to interpret as showing guilt.

Does what you are teaching incorporate that fact and avoidance of that danger? It can only be moral if it does.

there there let's support you, now do as yer told

From the British budget rather than the Scottish, in context of the announced end of austerity, an announced new spend of £10 million on mental health for ex-army. The Daily Record reported this, around their high suicide rate.

Which matters. Matters a lot to human life. Trauma of the whole military scene and experience, for all history it has been a bad aspect of the world that it exists. They printed a story of a life ended at age 28 by this impact. The more the need to care about it chips away at the brutal nature of what it is, the better for the whole condition of life.

But - problem. Daily Record is a powerful media, a world of its own, can print what it wants. It spun the solution, predictably, as being this higher spending. "need to know support will always be there." There is no way to make it print a word on the civil liberty danger behind what it advocates. The danger that the support turns into forcing things on them and ordering them to make personal changes unrelated to why they came for support.

The things said by the Record and govt are only common sense if the support shall not have that unsupportive oppressive dangerous power !

At the session of the UN Human Rights Council, High Commissioner Zeid Ra’adAl Hussein again called for the exclusion of psychiatric coercion, as an absolutely unacceptable violation of human rights. That is already for years the position of the UN Committee on rights of Disabled People. This latest step in human rights is publicly supportable thus:

Common travel binned already: try visiting Ireland.

Britain has been breaking the British Isles common travel area with Ireland, affecting both parts of it, without admitting so in any prominent political outlet.

Since 2010, shows this paper from when they started it, www.gov.uk/government/uploads/system/uploads/attachment_data/file/257182/cta.pdf, they have done immigration checks on the crossings from Northern Ireland to the mainland. It is shocking to see it, as I did on the Belfast to Cairnryan crossing, with "immigration enforcement" on their uniforms, checking identity and asking exactly immigration type questions about where you were travelling to - on a domestic travel route that is wholly inside the UK. It is not caused by NI's history, any extra security because of that would be security rather than open explicit immigration checking. Dangerously it does not make NI feel treated like part of the union, does it? The idea behind it is supposed to be, that the Republic is more liberal on immigration, and the Irish peace requires there to be easy crossing into NI by road an appearance of open border between the 2 parts of Ireland, so Britain will let the Republic's policy govern who can reach NI but it will still put a trap in an unexpected place to catch folks trying to reach the British mainland. This is why it is only being done in one direction, coming from Ireland, not going to it.

A friend who has visited family in the Republic reported that he was asked for his passport when crossing into NI on public transport! This is exactly what is not supposed to happen under the common travel area, and all our media debate on the EU and during the referendum took as common knowledge that it does not happen, that we have a happy little passport-free travel area with the Irish Republic. Googling, you can find stories since 2011 of this happening. It's not being publicised in media and politics, it's only folks who travle to Ireland and experience it who are getting to know this is happening.

As a No voter who is migration liberal and has no love at all for Britain's present border culture, I'm writing against Britain's practices here and accusing that they weaken the union. But this revelation is more of a problem for nats than unionists, because during the referendum the Yessers relied heavily on claiming they could predict that rUK would keep the common travel area with us because it would be rational. They insisted cavalierly that we could dismiss as bluff all contrary talk. Some Yessers actually relied on this, to argue that my anger at Yes's citizenship plan betraying the Scottish diaspora was unnecessary, because the common travel area resolved it. Predicting common travel's certainty to remain in place would mean, all the Scots born in the rest of Britain to emigrant parents and still living there at the date of indy, who Yes intended to betray without unrefusable citizenship of their own country, would still always be free to move home as part of common travel. So it would not matter how deficient and full of loopholes Yes's rules for Scottish citizenship were. This is clearly disproved by what is happening to Ireland. If intrusive migration checks are now capable of being intruded sinisterly upon civil liberties even inside the UK, between its nations, and if we are illicitly and dishonestly breaking the travel area with the Irish Republic too, both of these shocks show how easy and casual it would have been for rUK to put them onto a new Scottish state's border.

It's obviously another reason not to vote Conservative if you care for the union.

What to party for?

The partiers in Glasgow are right emotionally but they miss the point. We all pop our clogs, and unlike many folks, including for reasons of avoidable economic hardship under all governments in the neocon era she started, Thatcher lived to a full age anyone would be well satisfied with. That was a win for her. It is hardly a circumstance of death that there is anything in to celebrate. What's more, she took her leave of us with the huge satisfaction of being surrounded by disability welfare cuts and the media tough-talking us through a major depression, pushing the line that austerity is necessary and still on her side over economics even after the crash of 2008.

They are not pushing the voices who remind us that this is contrary to history and has a history of not working, which we are repeating. They only occasionally get heard buried long into the most serious radio current affairs slots when only the most intelligent and politically caring listeners are still istening, when the audience is lowest. Her death with neocon ideas still ruling and still pushed with a heavy hand by the tabloids, takes away the possibility that she would ever have to answer to the neocon system's end and a full properly complete exposing of all its human costs. That is a loss, not a gain. There would have been value against her ideas in her continued life until the neocon consensus ever ends.

The clear rebuttal to all the hard left voices whose regrets for her survival have gone as far as to sound sympathetic to terrorism, is that if she had been assassinated her ghost and supporters could always claim she would have gone on successfully for as long as she wished and never have fallen. Far better was scored against her ideas by her living to fall as she did at her own party's hands in 1990. Further to which, we all have our safety very ill served by those morally unscrupulous leading media voices who wrongly give the murder of Ian Gow any credit towards Thatcher's fall because they don't want ordinary people in the form of the anti-poll tax campaign to be seen to have achieved anything. Those media voices should be pursued criminally by the powers against encouraging terrorism.

We must not be conned by Salmond to read voting Yes as a vote against the neocon path originating from Thatcher. Without anywhere near enough public attention on it, he is sneaking in a measure against civil liberties that she never did, a charge for criminal defence even when you come out innocent. From his side too comes the tragedy of Thatcher's send off being the whole political class hammering us with money injustices. This measure of justice regression by Macaskill totally takes away the prospect that independence would end that.

At a time of austerity and with new measures against disability benefit starting from the same day as Thatcher died, there will be a public spending of £5 million on her funeral. Some very sensible folks have already pointed out that her biggest fans could afford to pay for this privately and her funeral should be privatised. If it angers you, contrast it not only with the British economic policy but with Macaskill undermining your democratic liberties and securities in pursuit of saving less than the political class routinely accept should be spent on Thatcher's funeral.

Chaos in a snapshot

Today's Scotsman is a complete snapshot of all the contradictory issues in collision, the whole smorgasbord of messing with we are getting from both sides.

"Salmond seizes high ground on welfare reform" its editorial says. Going for a campaign issue complete with mailshots to households, out of the welfare cuts process at British level. Going for the progressive consensus he keeps claiming exists in Scotland since the Tories ruined themselves here on constituional rather than welfare issues, and on the day when said fair minds will be alarmed by a result has been announced from the purge of Incapacity Benefit, when a third of its claimants have been pushed out of the benefits system into visibly much more precariously uncertain lives in the middle of a depression.

Intended message being - vote Yes if you have a conscience about benefits or a fear of being affected personally by their deconstruction. Yet news on the same day - the same day!! who managed that?!! - is that Salmond's government has passed the first stage of its undemocratic morally sinister Criminal Legal Assistance Bill, abolishing such a human rights basic as free legal defence against criminal charges, making criminal defence paid for. Even a proposal to refund the charge if you are found innocent got thrown out. Macaskill said it would make folks doubt the innocence of folks for whom the court decided not to refund it. But why would the court be given any power to decide that at all? That was not explained in the story.

Why was the story on this located under ordinary home news and away from the pages of referendum coverage? Do we have an elite wanting it not to become a referendum issue? After all, many lawyers and even the Edinburgh Bar Association were outside parliament demonstrating against the measure. As Salmond says vote Yes to protect the benefits system from getting destroyed, had he even noticed that the news on the same day said vote No to avoid living in a state to be founded with no tradition of a benefit of legal defence, where to suffer undeserved accusation of crime shall actually cost you money?

Who trusts a government capable of passing such a basic attack on human rights, with the human rights standards of a newly founded separate state?

This follows after Salmond's other recent show of ever so healthy ethics towards a question of law, his booboo on EU membership. This has affected the campaign oppositely than he wished. On the same day, in the same paper, a Labour No columnist, Brian Wilson, tells us that 60% of voters now appreciate that new state EU membership is not a bagged certainty, not "automatic" at all.

But what is the point of telling us that with the British EU referendum of 2017 hanging over us? Unless you can find a way to bring down the coalition and regain British government before the 2014 referendum and cancel the 2017 one, and be willing to cancel it despite its popularity with the racist vote? Assuming that hopeful scenario ain't in the offing and we are still stuck with these 2 votes in the wrong order, how you do even make a start on decide your vote by how to keep us in the EU when your vote is already being chaotically pulled opposite ways by the questions of how to protect our civil liberties and our benefits system?

How does a country with a progressive consensus end up with such an agonising and mucked up historic vote where there is no obvious progressive way to vote and either way will do nasty things to us? The civil liberty message to vote No has become, for safety in ordinary life, a pressingly urgent rival to the welfare message to vote Yes. While the EU membership message is no longer to vote Yes but may not yet be to vote No either. Who ever foresaw this scale of mess up?

You are all suspects now

A really important article by John Pilger on the cooperation between the Western powers to get rid of the presumption of innocence to an alarming extent, on grounds of security. How this is still going on as intensely as ever since 2001 despite the War on Terror petering out of the media.

Ask the SNP whether their new Scotland will still be part of this process. Watch out for whether they give any commitments otherwise, let along to reverse specific dangerous losses of civil liberty that have happened already.
